Rental & Class Terms and Conditions
AGREEMENT
PARTICIPANT hereby rents equipment from and/or enrolls in a class, tour, or instructional program (collectively, the "Activity") with Best Kayak Rentals LLC for the date(s), time(s), and location specified at booking. PARTICIPANT agrees, as further consideration for participation, that PARTICIPANT and all members of PARTICIPANT's party will comply with the following terms.
PARTICIPANT agrees to arrive on time and, for equipment rentals, to promptly return all equipment to the location rented from (if picked up or at place delivered) at the end of the rental period ("Return Time") in good condition. For classes, tours, or instructional programs, PARTICIPANT agrees to arrive prepared for the scheduled session at the location specified at booking; late arrival may result in reduced session time with no adjustment to the fee.
PARTICIPANT agrees that all equipment provided by Best Kayak Rentals remains its property and must be returned in good condition. PARTICIPANT is liable for all "Additional Charges" as may be determined by Best Kayak Rentals upon return of equipment or conclusion of the Activity. PARTICIPANT shall immediately notify Best Kayak Rentals staff or instructor if equipment is damaged or stolen.
PARTICIPANT understands and agrees that Best Kayak Rentals (and, for classes and tours, its instructors) reserves the right to require PARTICIPANT to relinquish use of equipment, or to remove PARTICIPANT from a class or tour, at any time due to unsafe or improper use, unsafe conduct, or failure to follow instruction. If, in the opinion of any Best Kayak Rentals employee or instructor, PARTICIPANT becomes incapacitated, violates any terms of this agreement, allows unauthorized or unfit person(s) to operate equipment, or otherwise cannot safely continue, PARTICIPANT agrees and understands no portion of the fee will be refunded.
CARE, USE & CONDUCT
All equipment is provided AS-IS, and PARTICIPANT shall keep it in good condition throughout the rental period or Activity.
All equipment must be operated in strict compliance with all state and federal laws and applicable safety and operating procedures. For classes and tours, PARTICIPANT must follow all instructor guidance, safety briefings, and direction at all times. Failure to follow the law, procedures, rules, or verbal instructions authorizes Best Kayak Rentals to immediately terminate this agreement or remove PARTICIPANT from the Activity without refund. Best Kayak Rentals reserves the right to refuse use of equipment or participation in an Activity to anyone.
Class and tour content, pacing, and skills covered are at the discretion of the instructor based on group ability, conditions, and safety considerations, and may vary from the published course outline.
LIABILITY FOR LOSS AND DAMAGE
If equipment is lost, stolen, or damaged, PARTICIPANT shall notify Best Kayak Rentals promptly.
At Best Kayak Rentals' option, the following expenses may be charged to the credit card on file, as an additional charge to the rental or Activity fee:
Paddle Replacement: $75.00/each
Life jacket replacement: $50.00/each
Single Kayak Replacement: $650.00
Tandem Replacement: $750.00
Paddleboard Replacement: $650.00
Canoe Replacement: $750.00
Repair to Watercraft: $100.00/minimum
ESSENTIAL ELIGIBILITY CRITERIA
To ensure a safe experience for all guests, participation in Best Kayak Rentals' rentals, classes, tours, and programs requires the ability to independently perform, or perform with reasonable assistance, the following Essential Eligibility Criteria (EEC). By signing this waiver, you confirm that you (or the minor/participant on whose behalf you are signing) can meet these criteria:
Breathe independently (i.e., not require medical devices to sustain breathing)
Independently maintain sealed airway passages while underwater
Independently hold head upright without neck / head support
Manage personal care independently or with assistance of a companion
Manage personal mobility independently or with a reasonable amount of assistance
Follow instructions and effectively communicate independently or with assistance of a companion
Independently turn from face-down to face-up and remain floating face up while wearing a properly fitted life jacket
Get in/out or on/off a paddlecraft independently or with a reasonable amount of assistance
Independently get out and from under a capsized paddlecraft
Reenter or remount the paddlecraft following deep water capsize independently or with a reasonable amount of assistance
Maintain a safe body position while attempting skills, activities and rescues listed in the appropriate Course Outline, and can recognize and identify to others when such efforts would be unsafe given your personal situation.
